Migrant workers have been enjoying better labor protection in Taiwan since a controversial five-day-workweek policy was implemented in August last year.
The Department of Labor of Taoyuan, northwestern Taiwan, says the amount of overtime pay for migrant workers who sought help from the department was NT$14 million (more than US$463,500) in the first half of this year. It said that was an increase from a year ago, according to a report by United Daily News, but it did not disclose the amount of overtime pay in the first half of 2016.
The number of labor disputes in Taoyuan, which has 20,000 foreign caregivers and 70,000 migrant factory workers, reached 1,907 in the first half of the year, most of which were due to issues involving overtime pay, it said. A total of 504 cases were settled.
Other employer malpractices included treating workers improperly, taking away employees’ passports, and discrimination.
The five-day-week policy, launched by Taiwanese President Tsai Ing-wen, ensures that a worker can enjoy one fixed holiday per week and another flexible rest day. A worker can get overtime pay if he or she is required to work on the flexible rest day.
Since the new rule was implemented in August 2016, the amount of outstanding overtime pay increased as migrant workers were entitled to higher wages, said Chang Cher-hung, chief of the Foreign Workers Service Section.
Chang said employers who failed to pay their employees overtime could be subject to fines ranging from NT$20,000 to NT$1 million.
The new rule was also implemented in other parts of Taiwan but local governments can set their own pace of launching penalties.

I agree very bad the police in Taiwan. They never use their brain and beside they don’t know their profession or doing as arresting the Immigrant…Like ,ex. Me, I was called the police station that I needed help on that moment . I complain my husband and his family to bursting and hurting me ..You know , what they did !They picked Up, Arrest me and my son then send to police station.I’ll try to show my identification documents completely and talking with them in English-language because I feel struggling and Very Upset and I’m truly Unhappy…For arresting me !!! I was broke , no money , no work , I just stayed at home that situation because I taking care my son 8 going to 9 years old only…But ,I can’t stop my anger .As a professional Migrants In Taiwan . I want to share my knowledge for what learned when I was in colleges.

Hope taiwan labor should strictly implement labor law to avoid disputes. As a migrant worker, we came here to earn money because of the poverty of our country.. ��
If poasible Taiwan government must check employee’s payslip or do an audit to counter check if the correct overtime pay is implemented by a company…
Employees were aware that we are not paid correctly but we cant do nothing against the company.

Huh. . We at Largan company. . Even holidays we need to work its . No holiday in this company while the other company is no work. And no double pay . Hoaliday we work with regular pay and we need to take overtime also no double pay .
Hope caretakers/caregivers would also included with this law because our job is not that easy we work 24/7 and yet the salary is not enough…

if it is true how come that they never implemented it? OT pay for me is the issue where in i am living already here in the Hospital eversince the day i was hired as a Caregiver.
