A 46-year-old Indonesian woman was sentenced to 15 months in jail after she pleaded guilty at the Shatin Magistrates Court to one count of working illegally.
The woman, who as an asylum seeker holds a temporary permit allowing her to stay in Hong Kong, was arrested by immigration department officer during an operation code-named “Twilight” on Monday, according to a government release.
The suspect was found washing dishes in a restaurant in Tuen Mun, the New Territories.
When confronted by immigration officials, she presented a recognizance form, which entitles the bearer to stay in Hong Kong, but prohibits the taking on of any employment, paid or unpaid.
According to the Immigration Ordinance, offenders are liable upon conviction to a maximum fine of $50,000 (US$6,370) and up to three years’ imprisonment. The Court of Appeal has issued a guideline ruling that a sentence of 15 months’ imprisonment should be applied in such cases.
Two employers suspected of employing the illegal worker were arrested. Investigations are ongoing.
