A 45-year-old Indian orthopedic surgeon in Hong Kong on an exchange program was found not guilty in Kowloon City Magistrates’ Court on Wednesday of indecent assault on a male nurse in Queen Elizabeth Hospital in April.
Sandip Ghosh greeted and shook hands with the nurse in a male changing room of the nurses’ quarters of the hospital on April 8, Sing Tao Daily reported.
The nurse accused Ghosh, who arrived in Hong Kong on April 3, of inappropriately touching him, but the surgeon said he was trying to find someone to help him fix his dislocated right shoulder.
The nurse recalled that the defendant had said, “do you like it?”
Ghosh said the dislocation was a recurrent condition and it had happened after he had been exercising that morning. He sought help from two other people, but was refused due to the language barrier.
Ghosh said he approached the nurse in the changing room to help him and was trying to show how he should pull his arm, but he had accidentally hit his buttocks, Apple Daily reported.
The magistrate accepted Ghosh’s explanation and his recurrent shoulder dislocation condition, and the misunderstanding that might have been arisen due to the victim misinterpreting the defendant’s English accent.
