시위를 주최한 민간인권전선(Civil Human Rights Front)은 2003년 7월 1일 홍콩판 국가보안법인 ‘기본법 23조’ 제정반대 때의 두 배인 103만 명(경찰 추산 24만 명)이 시위에 참여했다고 밝혔다.
범죄인 인도 법안은 홍콩으로 숨어든 범죄인을 중국으로 인도할 수 있도록 하는 법안인데, 중국 정부가 이를 악용해서 인권운동가나 정적(政敵), 외국인 기업인들을 마음대로 중국 본토로 송환해 정치성이 짙은 자국 법정에 세울 것이란 우려가 커지면서 이에 대한 반대 시위가 일어난 것이다.
불볕더위에도 불구하고 흰색 옷을 입은 시위대는 플래카드와 노란색 우산을 들고 영어와 광둥어로 범죄인 인도 법안 철회와 함께 행정 수반인 캐리 람 행정장관의 사퇴를 소리 높여 외쳤다. 람 장관은 반대에 부닥칠 가능성이 컸던 법안을 서둘러 처리하려고 했다는 비판을 받고 있다.
한 시위 참가자는 “범죄인 인도 법안이 통과되면 중국은 홍콩에 머무는 반중국 인사들을 마음대로 체포할 수 있게 된다”고 주장했다. 또 다른 시위 참가자도 “그것이 누구에게도 도움이 되지 않다는 걸 소리 높여 알릴 시간이 됐다고 생각한다”면서 “오늘이 뭔가를 바꿀 수 있는 날이 되기를 진심으로 바란다”고 말했다.
9일 시위는 대체로 평화로운 분위기 속에서 진행되었지만, 자정 직후 일부 시위대와 경찰이 충돌을 빚기도 했다.
홍콩 입법회는 12일 범죄인 인도 법안에 대한 논의를 시작할 예정인데, 법안은 월말까지는 통과될 것으로 예상되고 있다.
1997년 영국이 중국에 반환한 홍콩은 2047년까지 독립적 사법권이 보장돼 있다. 외교와 재계에서는 이러한 독립적 사법권 보장이 일국양제(一國兩制·한 국가 두 체제) 하에서 홍콩이 국제 무역과 금융 중심지로 자리매김할 수 있게 된 밑바탕이 됐다고 보고 있다.
미국, 캐나다, 영국과 같은 나라들뿐만 아니라 학계, 기업계, 외교계, 법조계에서도 범죄인 인도 법안에 대해 반대의 목소리를 내고 있다. 마이크 폼페이오 미국 국무장관은 지난달 “범죄인 인도 법안이 홍콩의 법치주의를 위협할 것”이라며 우려를 표시했다.
이처럼 법안에 대한 우려의 목소리에도 불구하고 람 장관의 지지세력만으로 법안 통과에 필요한 표를 충분히 확보할 수 있을 전망이다.
지난달에는 중국 당국과의 협력을 강조하는 친중국파(pro-establishment)와 중국과는 상관없이 홍콩의 민주주의를 우선시하자는 범민주파(pan-democracy) 사이의 갈등으로 입법회 개최가 연기됐다. 양측은 문제의 인도 법안과 관련해 별도의 청문회 개최를 시도했다.
홍콩 정부는 원래 1년 이상 징역형에 처할 수 있는 범죄자에 대해서 중국이 인도 요청을 할 수 있게 하려고 했지만, 두 차례 수정 끝에 법안 적용이 가능한 징역형 기준을 7년 이상으로 수정했다.
그러나 이러한 수정안도 법안 반대파를 설득하는 데 실패했다. 수정안은 홍콩 행정장관이 법원 심문 뒤에 외국 사법당국의 범죄인 인도 요청이 있을 때 이를 승인할 수 있게 허용함으로써, 범죄인 인도 협정을 평가할 수 있는 내각과 입법회의 감시 기능을 무력화시키고 있다.
필립 다이크 변호사는 ”양보안이 마련됐지만, 중요한 건 결과적으로 사람들이 중국으로 끌려가 불투명한 사법 체제하에서 법의 심판을 받게 될지 모른다는 걱정이다“고 말했다.
홍콩 법조계에서도 법안 반대 뜻을 분명히 밝혔다. 약 3,000명의 변호사와 법대 교수들은 6일 침묵 행진을 벌이면서 법안에 대해 더 광범위한 협의를 요구하는 한편, 법안 통과 시도에 대해 비난하고 있다.
하지만 람 장관은 지금까지 범죄인 인도 법안의 철회를 거부하고 있다. 그는 “오랫동안 지속된 법적 허점 때문에 홍콩이 중국 등지에서 수배 중인 범죄자들의 은신처가 됐다”면서, 범죄인 인도 법안이 그런 허점을 메우는 데 중요한 역할을 할 것이라고 주장하고 있다.
예를 들어, 법안이 신속히 통과돼야 지난해 대만에서 임신한 여자친구를 살해한 혐의를 받는 홍콩 남성 찬통카이를 대만으로 보내 재판을 받게 할 수 있다는 것이다. 하지만 정작 범죄인 인도 법안을 반대하고 있는 대만은 찬통카이를 돌려받지 않겠다고 말하고 있다.
중국과의 홍콩 인도 협상에 참여했던 말콤 리프킨드 전 영국 외무장관은 최근 ‘사우스차이나 모닝포스트’지 기고문에서 이 문제를 거론하면서 “(홍콩) 인도 협상가들이 실수로 ‘허점’을 남겼지만, 대신 홍콩의 사법적 독립을 지키는 데 ‘필요한 방화벽’을 설치했다”고 말했다. 그는 “홍콩 사법체계가 독립성을 유지하려면 계속해서 방화벽이 필요하다”며 ”범죄인 인도 법안은 일국양제 하에서 홍콩에 보장된 자치권이 새로운 압력을 받고 있음을 의미한다“고 덧붙였다.
중국의 법치주의가 본토로 송환될 위험이 있는 홍콩인들을 안심시켜줄 만큼 충분히 개선되지 않았다고 믿고 있는 중국인권변호사협회(China Human Rights Councils)의 회원인 충이룽은 ”중국의 홍콩 간섭이 점점 더 심해지고 있다“면서 ”범죄인 인도 법안은 중국에 많은 옵션을 줄 것이다“고 주장했다.
