A 75-year-old man was acquitted of six counts of indecent assault on an Indonesian domestic worker at the West Kowloon Magistrates’ Court on Friday.
Magistrate Edward Wong Ching-yu said he found discrepancies between testimonies and statements by the victim, a 26-year-old Indonesian domestic worker, and found the defendant not guilty, the Oriental Daily reported.
The victim, identified as X in the court, accused Lei Hang-gong of massaging her breast for 10 to 15 minutes six times, while claiming that a massage could improve her body odor.
The woman told the court that the defendant assaulted her when her employer – the defendant’s son and his family – were away on holidays in June, 2017.
She said the defendant claimed his grandchildren complained about her body odor, so he gave her a deodorant and asked her to take off her clothes for an examination. She also claimed the defendant massaged her breast, claiming it would solve her body odor problem.
The magistrate said the woman described in detail each count of indecent assault at the trial and demonstrated how the defendant massaged her breast, but she did not resist, object or simply say no to the defendant.
Also, the woman did not mention this in her statements. The magistrate also found discrepancies between the statement and the testimony the woman made, Ming Pao Daily reported.
The victim said the man threatened to fire her if she did not take off her clothes, but she did not mention this point during the trial. The magistrate ruled the defendant not guilty.
