A 55-year-old Hong Kong employer was sentenced to 11 years in jail by the High Court on Tuesday for raping and sexually assaulting a newly arrived Indonesian domestic worker.

Judge Patrick Li Hon-leung called Tsang Wai-san “despicable” and criticized his outrageous behavior. The judge said Tsang had violated his integrity as an employer and treated his worker in an inappropriate and violent way, Apple Daily reported.

The court earlier heard that the defendant, who was unemployed, hired the 27-year-old Indonesian domestic worker to take care of his mentally disabled daughter. On December 10, 2017, Tsang molested the victim on her first working day at his home in Kowloon’s Lower Wong Tai Sin Estate while she was sleeping.

He indecently assaulted her again on December 18 in the same room, which she shared with his mentally handicapped daughter. On December 19, he dragged her out of the room and raped her on the bed in his room.

He raped her again when she was washing dishes in the kitchen in the afternoon on December 20 when his wife was not home. The worker kept a sample of the defendant’s semen as evidence and sought help from the Consulate General of Indonesia on December 21.

The defendant’s lawyer pleaded for leniency, saying he was the breadwinner of the family and needed to take care of his special needs daughter. But the judge cited the victim’s medical report, saying the domestic worker had suffered from post-traumatic stress disorder since the incident.

She became easily depressed and even had tried harming herself and committing suicide. Li also criticized the defendant for not using a condom. The judge said the sentence had to be severe enough to create a deterrent effect.
