An employment agency in the New Territories’ Tsuen Wan was fined HK$8,000 (US$1,019) at West Kowloon Magistrates’ Court on Wednesday for overcharging a domestic worker.
The Employment Agencies Administration of the Labour Department received a complaint from a domestic worker in March last year against My Friends Service Ltd in Nan Fung Center in Tsuen Wan for charging her excessive an commission, according to a government release.
The domestic worker agreed to assist in the investigation and help provide evidence. This was the third time this year an employment agency had been convicted of overcharging.
According to the law, an employment agency is not allowed to collect any fees or charges from job seekers other than the prescribed commission, which is set at no more than 10% of the first month’s salary upon successful placement.
The press release did not mention the rate the company overcharged.
Any agency which fails to comply with the law may be prosecuted or lose its license. Also, the penalty for overcharging job-seekers is a maximum fine of HK$350,000 and three years in jail.
