A Filipino man was found guilty on two counts of indecent assault on a Filipina domestic worker at the Eastern Magistrates’ Court on Wednesday.

Jesnar Bade, 55, a Hong Kong resident who worked for a security company as a maintenance man, was remanded in custody until May 2 pending a community service report, the sunwebhk.com reported.

The victim had earlier told the court that Bade had embraced her from behind twice and tried to hold her breasts when she asked him to teach her how to bypass the alarm system in her employer’s house in Mid-Levels in July last year.

She said she covered her breasts with her arms and elbowed him with her right arm, telling him to back off. But the defendant allegedly replied: “Okay, but I’ll have to kiss you then,” before stepping away.

About 30 minutes later, the victim received a WhatsApp message from Bade, which said he had an erection because of her. She showed the message to her employer’s mother-in-law, who called in a manager of GS4, the security company Bade worked for. The manager advised them to call police.

In a written verdict, Magistrate Cheung Kit-yee rejected the defendant’s claim that he only tapped the victim on the shoulder and did not embrace her. The judge said she found the complainant credible because the woman’s evidence was straightforward and clear, adding it unacceptable and unreasonable for a male stranger to embrace a woman from behind and to do it twice.

The defense lawyer said in mitigation that Bade was a first offender, had a clear record and a good family, adding that he had a good work record in the security company that he had served for 24 years. The lawyer argued for community service for the defendant instead of a jail term.
