An Indonesian woman was jailed for 18 months by a Shatin Magistrates’ Court last week on charges of working illegally and using a forged Hong Kong identity card after being caught in a raid early this month, according to a government statement.
The woman, 46, was working as a dishwasher in a restaurant in Taikoo Shing on Hong Kong Island during the raid by the Immigration Department on August 1.
She showed the officers a forged Hong Kong ID card. Further investigation revealed that she was a non-refoulement claimant who did not have the right to work in the city.
An employer who allegedly hired the woman was arrested and the department is investigating the case.
A spokesman for the Immigration Department warned that as stipulated in Section 38AA of the Immigration Ordinance, illegal immigrants or people who are the subject of a removal order or a deportation order are prohibited from taking any employment, whether paid or unpaid, or establishing or joining in any business. Offenders are liable upon conviction to a maximum fine of HK$50,000 (US$6,400) and up to three years’ imprisonment.
It is also an offense to use or possess a forged Hong Kong identity card. Offenders are liable to prosecution and a maximum penalty of a HK$100,000 fine and up to 10 years’ imprisonment.

Illegally working + Possession of Forged HKID …18 months guys is fair..illegal working by standard is 3 years maximum and possession of Forged HKID is maximum 10 years and 100K penalty.
I know we all dont want this to happen to us..but I think we simply follow the law wherever we decide to live. This is not our country…we have to learn to respect the law of the country we live in. Unfortunately we don’t have much power to control or request. A law is a law. Follow them and no harm done 🙁
